TextConvo, LLC ("TextConvo," "we," "our," or "us") provides an artificial intelligence-powered communications platform that enables businesses to engage with customers and other individuals through channels that may include SMS, MMS, Rich Communication Services ("RCS"), email, artificial intelligence-assisted or artificial intelligence-generated voice communications, WhatsApp, and other supported communications channels.
This Privacy Notice describes how TextConvo collects, uses, discloses, retains, and protects personal information when individuals: visit or interact with our websites; create or administer a TextConvo account; use our platform, software, APIs, integrations, applications, and related services; communicate directly with TextConvo; receive or interact with communications delivered through the TextConvo platform; or otherwise interact with products or services that link to this Privacy Notice.
Our websites, platform, software, APIs, integrations, applications, and related services are collectively referred to as the "Services." This Privacy Notice does not replace the privacy notices or legal obligations of businesses that use TextConvo to communicate with their customers, prospects, employees, applicants, or other individuals.
For customers that have entered into a written agreement with TextConvo, TextConvo's processing of Customer Data is also governed by that agreement and, where applicable, a Data Processing Addendum or other data-protection agreement. If there is a conflict between this Privacy Notice and such an agreement regarding TextConvo's processing of Customer Data, the applicable written agreement will control to the extent of the conflict.

1. Scope and Our Role
TextConvo may process personal information in different capacities depending on the circumstances.
TextConvo as a Business or Controller
TextConvo may determine the purposes and means of processing personal information when we collect information directly for our own business activities, including:
- Operating our websites
- Establishing and administering customer accounts
- Managing billing and commercial relationships
- Providing customer support
- Securing and improving the Services
- Communicating about TextConvo products and services
- Complying with legal obligations
In these circumstances, TextConvo may act as a business, controller, or similar regulated entity under applicable privacy law.
TextConvo as a Service Provider or Processor
TextConvo generally processes customer contact data and communications data on behalf of businesses using the Services. These businesses determine:
- Who will be contacted
- What information will be uploaded or connected to the Services
- Which communications channels will be used
- What communications will be sent
- The purpose and legal basis for the communications
- Whether AI-generated or automated communications will be enabled
- Whether calls will be recorded or transcribed
- Customer retention settings and instructions, subject to TextConvo's contractual rights and obligations, legal requirements, security requirements, backup practices, suppression obligations, and other permitted retention purposes
In these circumstances, the TextConvo customer generally acts as the business or controller, and TextConvo acts as its service provider or processor. When TextConvo processes information on behalf of a customer, privacy requests and questions concerning the customer's collection or use of that information should ordinarily be directed to the business that initiated the communication or collected the information.
2. Information We Collect
The information we collect depends on how the Services are used, which communication channels are enabled, and the information supplied by our customers and users.
2.1 Account and Business Information

- Job title or business role
- Account username and credentials
- Account permissions and administrative settings
- Billing contact information
- Subscription and transaction information
- Customer preferences
- Communications with our sales, customer success, compliance, and support teams
- Information supplied during onboarding or implementation
Payment card information may be collected and processed directly by an authorized payment processor rather than stored by TextConvo.
2.2 Customer-Provided Contact and Lead Data
Customers may upload, transmit, integrate, or otherwise make available information about individuals, including:
- Names
- Telephone numbers
- Email addresses
- Mailing addresses
- Customer or lead identifiers
- Communication preferences
- Consent, opt-in, and opt-out records
- Suppression records
- Lead-source information
- Customer relationship management data
- Appointment or transaction information
- Account or service status
- Custom fields
- Customer-provided segmentation data
- Prior communications
- Other information selected by the customer
Customers are responsible for ensuring that they have the legal authority to collect and provide this information to TextConvo.
2.3 Messaging and Communications Data
Depending on the enabled channels, we may process:
- SMS, MMS, RCS, WhatsApp, and other message content
- Email content
- Sender and recipient information
- Message timestamps
- Attachments and media
- Delivery, failure, bounce, and routing information
- Carrier and communications-provider information
- Conversation histories
- Replies and customer intent signals
- Link clicks and other engagement information
- Read or delivery status, when supported
- Keyword responses
- Opt-in, opt-out, unsubscribe, and suppression activity
- Campaign, workflow, and template information
- AI-generated or AI-assisted communications
2.4 AI Voice and Telephone Communications Data
When voice functionality is enabled, we may process:
- Originating and destination telephone numbers
- Call date, time, duration, disposition, and routing information
- Call recordings, when recording is enabled
- Call transcripts
- Speech-to-text and text-to-speech data
- AI-generated voice content
- Call summaries
- Call classifications and outcomes
- Key topics, intent, and sentiment indicators
- Transfer and escalation information
- Interactive voice response selections
- Voicemail content
- Consent, disclosure, and opt-out records
- Technical information relating to voice quality and call delivery
Depending on the Service configuration, Customers may enable recording, transcription, monitoring, sentiment analysis, summarization, or similar functionality. Customers are responsible for determining whether such functionality is lawful for their use case and for providing all required notices and obtaining all required consents. TextConvo may provide configurable notices or technical controls, but those features do not replace the Customer's legal obligations.
TextConvo does not intentionally create voiceprints or use voice data to uniquely identify an individual unless that functionality is expressly implemented, appropriately disclosed, and authorized in accordance with applicable law and contract.
2.5 Email Communications Data
When email functionality is enabled, we may process:
- Email addresses
- Sender, recipient, reply-to, and routing information
- Email subject lines and body content
- Attachments
- Delivery, bounce, and complaint information
- Open, click, reply, and engagement data, where enabled
- Subscription and unsubscribe records
- Suppression-list information
- Campaign and template information
- Authentication and domain configuration information
2.6 Consent and Compliance Data
- The date and time consent was provided
- The method or source through which consent was obtained
- The telephone number or email address associated with the consent
- The applicable consent language or disclosure

3. Sensitive Personal Information
The Services are not designed for the unrestricted collection of sensitive personal information.
Depending on customer use, communications may nevertheless contain information considered sensitive under applicable law, including:
- Account credentials
- Precise geolocation
- Government-issued identifiers
- Financial account information
- Health information
- Information concerning race, ethnicity, religion, sexual orientation, citizenship, or immigration status
- Biometric information
- Contents of certain private communications
- Personal information concerning a known child
Customers may not submit protected health information, payment-card data, government identifiers, precise geolocation, biometric identifiers, or other highly sensitive or regulated information unless the applicable Service permits it and TextConvo has expressly authorized the use in an Order Document or other written agreement, together with any required Data Processing Addendum, Business Associate Agreement, service-specific addendum, or security controls. TextConvo may restrict or prohibit use cases involving regulated or highly sensitive information.
4. How We Use Information
We may use personal information to:
- Provide, operate, configure, and maintain the Services
- Create and administer accounts
- Enable SMS, MMS, RCS, email, voice, WhatsApp, and other communications
- Route and deliver communications through carriers and communications providers
- Generate, analyze, summarize, classify, or respond to communications using AI
- Support conversational workflows and channel orchestration
- Authenticate users and secure accounts
- Process transactions and administer subscriptions
- Provide onboarding, support, implementation, and professional services
- Maintain consent, unsubscribe, opt-out, and suppression records
- Detect and prevent fraud, spam, abuse, security incidents, and unauthorized activity
- Monitor performance, availability, deliverability, and reliability
- Troubleshoot errors
- Analyze usage and improve the Services
- Develop new products and functionality
- Generate aggregated or de-identified analytics
- Communicate about accounts, transactions, service changes, and security
- Market TextConvo products and services as permitted by law
- Enforce agreements and acceptable-use requirements
- Investigate complaints and disputes
- Protect the rights, safety, and property of TextConvo, our customers, and others
- Comply with contractual, legal, regulatory, law-enforcement, carrier, and industry requirements
- Complete a corporate transaction or organizational restructuring
Where required, we rely on an appropriate legal basis, which may include consent, performance of a contract, compliance with law, protection of legitimate interests, or another legally permitted basis.
5. Artificial Intelligence and Automated Processing
The Services may use artificial intelligence, machine learning, natural-language processing, speech recognition, speech synthesis, and other automated technologies to:
- Generate or recommend messages
- Conduct AI-assisted or AI-generated voice conversations
- Transcribe and summarize calls
- Categorize communications
- Identify customer intent
- Route conversations
- Trigger workflows
- Recommend next actions
- Support quality assurance
- Evaluate communication performance
- Detect prohibited, fraudulent, or abusive activity
- Improve service functionality
AI-generated outputs may be inaccurate, incomplete, or inappropriate. Customers are responsible for configuring, supervising, testing, and using AI-enabled features appropriately and for determining when human review or intervention is required.
TextConvo may use third-party AI, speech-processing, or infrastructure providers to provide AI-enabled functionality. Data supplied to these providers is subject to contractual, technical, and operational safeguards appropriate to their role.
TextConvo does not use Customer Data to train publicly available or shared foundational AI models unless the customer expressly authorizes that use.
TextConvo may use Usage Data, telemetry, feedback, aggregated information, and de-identified information to operate, secure, maintain, analyze, evaluate, and improve the Services, subject to applicable agreements and law. When such information is used outside providing the Services to a particular Customer, TextConvo will use it in a manner that does not identify the Customer or an End User, except as otherwise expressly authorized by the applicable agreement.
Unless expressly stated otherwise, TextConvo does not use automated processing to make decisions that produce legal or similarly significant effects concerning individuals on TextConvo's own behalf. Customers remain responsible for evaluating whether their use of automated processing implicates profiling, automated-decision, notice, consent, assessment, or opt-out requirements.
6. How We Disclose Information
We may disclose personal information as described below.
6.1 Customers and Authorized Users
Information processed through the Services may be accessible to the customer that supplied the information and to its authorized administrators, employees, contractors, agents, and integration partners.
6.2 Communications Providers
We disclose information as necessary to communications carriers, messaging aggregators, email delivery providers, telephone providers, RCS providers, WhatsApp providers, and other channel infrastructure providers to route, deliver, authenticate, and monitor communications.
6.3 Cloud, Security, and Infrastructure Providers
We may disclose information to providers that support hosting, databases, content delivery, authentication, monitoring, security, backup, storage, and infrastructure operations.
6.4 AI, Speech, and Analytics Providers
When relevant features are enabled, information may be processed by providers that support:
- Large language models
- Speech recognition
- Text-to-speech generation
- Transcription
- Voice infrastructure
- Translation
- Conversation analysis
- Quality assurance
- Data analytics
- Automated workflow functionality
6.5 Integrations, Subprocessors, and Customer-Directed Third Parties
TextConvo may use carriers, telecommunications providers, email providers, AI and speech providers, cloud infrastructure providers, analytics providers, security providers, and other subprocessors to provide the Services. Those providers may process Customer Data on TextConvo's behalf or as otherwise necessary to provide their services. Their processing may also be subject to applicable contractual terms, provider requirements, and law.
When a customer enables an integration or directs TextConvo to exchange information with another service, we may disclose information to that service at the customer's direction. Third-party services are governed by their own privacy terms.

- Cooperate with regulators, communications providers, or law-enforcement authorities
- Enforce agreements and policies
- Investigate fraud, abuse, or security incidents
- Protect TextConvo, our customers, users, or the public
- Establish, exercise, or defend legal claims
6.8 Corporate Transactions
Information may be disclosed or transferred in connection with an actual or proposed financing, merger, acquisition, restructuring, reorganization, bankruptcy, sale of assets, or similar corporate transaction.
6.9 With Consent or Direction
We may disclose information when an individual or customer consents to or directs the disclosure.
7. Sale, Sharing, and Targeted Advertising
TextConvo does not sell personal information to third parties. TextConvo does not sell Customer Data or personal information for monetary consideration.
TextConvo does not disclose SMS, RCS, telephone, email opt-in, or consent information to third parties or affiliates for their independent marketing purposes. We do not sell your phone number or SMS consent information.
TextConvo may use limited website analytics, advertising, or similar technologies that could be characterized as "sharing," targeted advertising, or a sale under certain state privacy laws, depending on how those laws define the relevant terms and which technologies are enabled.
Where required, TextConvo will provide an appropriate method to opt out of covered selling, sharing, or targeted advertising. TextConvo will also process applicable legally recognized browser-based opt-out preference signals where required by law.
A customer's disclosure of information through the Services is governed by that customer's privacy practices. Customers may not use TextConvo to sell personal information or engage in targeted advertising unless permitted under their TextConvo agreement and applicable law.
8. Communications Consent and Customer Responsibilities
Customers determine and control the purpose, audience, timing, frequency, content, scripts, prompts, offers, call flows, sender identities, telephone numbers, domains, suppression rules, and business rules for Communications conducted through the Services. Except for Communications TextConvo independently initiates for its own purposes, TextConvo generally acts as a technology provider processing Communications at the Customer's direction.
Customers are responsible for:
- Establishing a valid legal basis for each communication
- Obtaining any consent or authorization required for SMS, MMS, RCS, telephone, AI voice, prerecorded voice, artificial voice, email, WhatsApp, or other communications
- Maintaining adequate consent and authorization records
- Providing disclosures required at or before collection
- Properly identifying the person or entity initiating a communication
- Complying with calling-hour, frequency, content, caller-identification, and do-not-call requirements
- Honoring consent revocations and channel-specific opt-out requests
- Communicating to TextConvo opt-out, unsubscribe, revocation, or suppression requests received outside the Services and coordinating suppression across their own systems, vendors, brands, affiliates, campaigns, and communication channels
- Complying with call-recording and transcription laws
- Providing legally required AI or automated-communication disclosures
- Ensuring that communications are accurate and not deceptive
- Ensuring that recipient lists were collected and are used lawfully
- Complying with applicable laws, regulations, carrier standards, platform rules, and industry requirements
TextConvo will process supported opt-out, unsubscribe, revocation, or suppression requests received directly through configured Service mechanisms. TextConvo may provide tools intended to support compliance, but TextConvo does not determine whether a customer's particular communication is lawful.
9. SMS, MMS, and RCS Communications
TextConvo and its customers may use SMS, MMS, and RCS for transactional, informational, customer-service, authentication, marketing, conversational, and other authorized communications. Consent requirements depend on the nature of the communication, the technology used, the recipient, and applicable law.
TextConvo-Operated Messaging Programs
TextConvo operates SMS-based communication programs including account verification (OTP), customer support, and demo interactions. TextConvo requires prior express written consent before sending marketing or promotional SMS messages through TextConvo-operated programs. Individuals may opt in to receive SMS messages from TextConvo through one or more of the following methods:
- Entering their phone number on our website and providing explicit consent by selecting an unchecked SMS consent checkbox during signup, login, or a demo request;
- Texting a keyword (e.g., START TCDEMO) to +1 855 910 0625; or
- Scanning a QR code that opens the individual's messaging app with a pre-filled SMS message (e.g., START TCDEMO) to +1 855 910 0625.
By submitting a phone number via our website or texting an enrollment keyword, the individual provides express written consent to receive SMS messages from TextConvo, including AI-generated conversational responses.
We collect and securely retain SMS consent records, including the phone number, opt-in timestamp, method of consent, and the disclosure text presented at the time of consent, in accordance with applicable laws and regulations.
Where an individual enrolls in a TextConvo-operated messaging program:
- Message frequency may vary
- Message and data rates may apply
- Consent is not a condition of purchase or use of the TextConvo platform
- The individual may reply STOP at any time to cancel
- The individual may reply HELP for assistance or contact legal@textconvo.ai
- Additional terms presented at the point of enrollment will apply
SMS opt-in data and consent will not be shared with third parties or affiliates for marketing purposes. TextConvo may maintain opt-in, opt-out, consent, and suppression records for compliance, security, and dispute-resolution purposes. Wireless carriers and communications providers are not responsible for delayed or undelivered messages.
10. Email Communications
TextConvo and its customers may use email for transactional, informational, security, support, account, and commercial communications.
Commercial emails sent directly by TextConvo will include an appropriate unsubscribe mechanism where required. TextConvo will process applicable unsubscribe requests within the legally required period, although an individual may continue to receive non-promotional messages such as account, billing, security, or service notices.
Customers are independently responsible for ensuring that their email communications comply with applicable laws, including requirements governing:
- Sender and header information
- Subject lines
- Advertising identification
- Physical postal addresses
- Subscription and consent requirements
- Unsubscribe mechanisms
- Suppression lists
- The timely processing of opt-out requests
11. AI Voice Calls, Recording, and Transcription
The Services may enable customers to place or receive calls using AI-generated, synthetic, artificial, prerecorded, or human-assisted voices.
Depending on the use case, an AI voice call may be subject to consent, disclosure, identification, recording, transcription, telemarketing, do-not-call, and opt-out requirements.
Customers are responsible for obtaining any prior express consent, prior express written consent, or other authorization required based on the type, purpose, technology, recipient, and jurisdiction of the call.
Customers must also ensure that:
- The calling party is properly identified
- Any required artificial-intelligence or artificial-voice disclosure is made
- Recording and transcription disclosures are provided
- Required consent to record or transcribe is obtained
- Opt-out or do-not-call requests are honored
- Calls comply with applicable federal, state, local, and international law
TextConvo's provision of AI Voice functionality, call configuration, scripts, recording features, opt-out functionality, or related technical assistance does not constitute a determination that a Customer's calls are legally compliant.
Where appropriate, calls may be transferred or escalated to a human representative. Individuals should not provide highly sensitive information during an AI voice interaction unless the requesting business has clearly authorized and secured that use.
An individual who does not wish to continue an AI-assisted call may end the call or communicate an opt-out request to the calling business.
12. Authentication and Security Messages
TextConvo may send one-time passwords, verification codes, fraud alerts, security messages, or similar communications in response to user activity.
These communications are generally transactional rather than promotional. Opting out of authentication or security communications may prevent access to portions of the Services or interfere with account-security functionality.
13. Cookies and Similar Technologies
We and our service providers may use cookies, pixels, software development kits, local storage, log files, and similar technologies to:
- Operate the website and Services
- Authenticate users
- Remember preferences
- Maintain security
- Prevent fraud
- Analyze performance and usage
- Diagnose errors
- Improve functionality
- Support marketing and advertising, where enabled
Users may control certain cookies through browser settings or a cookie-management tool made available on the website. Blocking some cookies may impair website or platform functionality. Where required, we will request consent before using nonessential cookies or similar technologies.
14. Data Retention
We retain personal information for no longer than reasonably necessary for the purposes described in this Privacy Notice, including to provide the Services, comply with customer instructions, satisfy legal obligations, maintain security, prevent fraud, resolve disputes, enforce agreements, and maintain required suppression or compliance records.
Customer Data may also be retained as permitted or required by the applicable customer agreement, Data Processing Addendum, legal hold, applicable law, carrier or provider requirement, security need, fraud-prevention requirement, backup process, or compliance obligation.
Retention depends on factors including:
- The type and sensitivity of the information
- The customer's configuration and instructions
- Contractual commitments
- Account status
- The length of the business relationship
- Legal and regulatory requirements
- Carrier and communications-provider requirements
- Security considerations
- Applicable limitation periods
- The need to maintain evidence of consent, revocation, suppression, or compliance
Information may remain in backups, archives, logs, or disaster-recovery systems for a limited period after deletion from active systems. TextConvo may retain a minimal suppression record after an opt-out or deletion request when necessary to ensure that the individual is not contacted again.
15. Security
TextConvo maintains commercially reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, use, alteration, acquisition, destruction, loss, misuse, or disclosure.
Safeguards may include:
- Encryption in transit
- Encryption at rest where appropriate
- Identity and access controls
- Authentication mechanisms
- Role-based permissions
- Logging and monitoring
- Network and infrastructure protections
- Secure development practices
- Vendor risk management
- Incident-response procedures
- Backup and recovery controls
- Workforce confidentiality and security requirements
No security measure or transmission method can guarantee absolute security. Customers are responsible for securing their credentials, systems, integrations, endpoints, and authorized-user access.
A person who believes an account or communication has been compromised should contact TextConvo promptly at legal@textconvo.ai.
16. Privacy Rights
Depending on the individual's jurisdiction and subject to applicable exceptions, an individual may have the right to:
- Confirm whether personal information is being processed
- Access personal information
- Obtain a copy of personal information
- Correct inaccurate personal information
- Delete personal information
- Obtain personal information in a portable format
- Opt out of the sale of personal information
- Opt out of sharing for cross-context behavioral advertising
- Opt out of targeted advertising
- Opt out of certain profiling or automated decision-making
- Limit certain uses or disclosures of sensitive personal information
- Withdraw consent
- Appeal the denial of a privacy request
- Receive equal service and pricing without unlawful discrimination for exercising privacy rights
Requests concerning information TextConvo controls may be submitted to legal@textconvo.ai. The request should identify the nature of the request and the relationship with TextConvo. We may need to verify the requester's identity and authority before fulfilling a request.
An authorized agent may submit a request where permitted by law. We may require evidence that the agent is authorized to act for the individual.
When TextConvo processes personal information on behalf of a Customer as a service provider or processor, TextConvo generally acts on the Customer's instructions with respect to access, correction, deletion, portability, restriction, and other applicable privacy rights. TextConvo may direct an individual to the applicable Customer and may assist that Customer in fulfilling a verified request as required by the applicable agreement or law. Individuals who received a communication from a TextConvo customer should ordinarily submit their request directly to the business identified in the communication.
Where applicable, appeal requests may be submitted to legal@textconvo.ai with the subject line "Privacy Request Appeal."
17. State-Specific Privacy Disclosures
Residents of certain U.S. states may have additional rights under state privacy laws.
During the preceding 12 months, TextConvo may have collected the categories of personal information described in Section 2 from the categories of sources described in Sections 2 and 6. We may have used and disclosed those categories for the business and commercial purposes described in Sections 4 and 6.
Categories of recipients may include:
- TextConvo customers and authorized users
- Communications carriers and channel providers
- Cloud and infrastructure providers
- AI and speech-processing providers
- Analytics and security providers
- Integrations selected by customers
- Payment processors
- Professional advisers
- Governmental authorities
- Parties to a corporate transaction
TextConvo does not knowingly sell or share the personal information of individuals under 16 for targeted or cross-context behavioral advertising.
TextConvo does not use or disclose sensitive personal information for purposes that require a right to limit under California law unless an appropriate notice and method to exercise that right are provided.
18. International Data Transfers
TextConvo is based in the United States. Personal information may be processed in the United States and in other countries where TextConvo, our customers, or our service providers operate. These countries may have privacy laws that differ from those of the individual's jurisdiction.
Where required, TextConvo uses legally recognized safeguards for cross-border transfers, which may include contractual protections and data-processing agreements.
19. Aggregated and De-Identified Information
TextConvo may create and use aggregated or de-identified information that cannot reasonably be linked to an identified or identifiable individual.
We may use this information for:
- Analytics
- Benchmarking
- Product development
